El contrato

The contract

Tomador del seguro Policyholder (tomador) Quien firma y paga la póliza. The person who signs and pays for the policy.

Es la persona que contrata el seguro con la compañía y se compromete a pagar la prima. Puede ser el mismo que el asegurado (el propietario que vive en la casa) o una persona distinta, por ejemplo un padre que asegura el piso de su hijo.

The person who takes out the insurance with the company and undertakes to pay the premium. They may be the same as the insured (the owner who lives in the house) or a different person, for example a parent insuring their child's flat.

Asegurado Insured person (asegurado) Quien está protegido por la póliza. The person protected by the policy.

Es la persona cuyo interés está protegido. En un hogar habitual, el asegurado es quien vive en la vivienda. Las pólizas también suelen extender esta protección al cónyuge y a los familiares que conviven en el mismo domicilio.

The person whose interest is protected. In a typical home, the insured is whoever lives in the property. Policies usually also extend this protection to the spouse and relatives living at the same address.

Prima Premium (prima) El precio que se paga por el seguro. The price paid for the insurance.

Es la cantidad que abona el tomador a la compañía, normalmente cada año, a cambio de la cobertura. Si no se paga la prima, el seguro no entra en vigor. Algunas pólizas permiten el pago fraccionado: semestral, trimestral o mensual.

The amount the policyholder pays the company, usually each year, in exchange for cover. If the premium is not paid, the insurance does not take effect. Some policies allow instalments: half-yearly, quarterly or monthly.

Condiciones particulares Policy schedule (condiciones particulares) Las páginas personalizadas de tu póliza. The personalised pages of your policy.

Son el documento donde aparecen los datos específicos de tu contrato: la dirección asegurada, los capitales contratados para continente y contenido, las coberturas elegidas y el precio. Son únicas para cada cliente.

The document showing the specific details of your contract: the insured address, the sums insured for buildings and contents, the chosen cover and the price. They are unique to each client.

Condiciones generales Policy wording (condiciones generales) Las reglas comunes que aplican a todos. The common rules that apply to everyone.

Es el documento estándar de la compañía que explica cómo funciona cada cobertura, qué está excluido y cuáles son los derechos y obligaciones de ambas partes. Es igual para todos los clientes con el mismo producto.

The company's standard document explaining how each cover works, what is excluded and the rights and obligations of both parties. It is the same for all clients with the same product.

Franquicia Excess / Deductible (franquicia) La cantidad que pagas tú antes de que actúe el seguro. The amount you pay before the insurer steps in.

Es un importe fijo que corre por tu cuenta en cada siniestro. Por ejemplo, si hay una franquicia de 150 € y el daño es de 600 €, la compañía paga 450 €. A mayor franquicia, menor prima anual. Algunas coberturas, como la responsabilidad civil, no tienen franquicia.

A fixed amount you pay out of pocket on each claim. For example, with an excess of €150 and damage of €600, the company pays €450. The higher the excess, the lower the annual premium. Some covers, such as liability, have no excess.

Defensa jurídica Legal defence (defensa jurídica) El seguro que paga tu abogado. The cover that pays for your lawyer.

Cubre los honorarios de abogado y procurador cuando necesitas defender tus intereses o reclamar tus derechos: conflictos con la comunidad de propietarios, con arrendatarios, reclamaciones a terceros por daños... El límite y el alcance varían mucho entre pólizas.

Covers solicitor and court agent fees when you need to defend your interests or claim your rights: disputes with the residents' community, with tenants, claims against third parties for damage... The limit and scope vary greatly between policies.

Los bienes asegurados

The insured property

Continente Building / Structure (continente) La estructura física de la vivienda. The physical structure of the home.

Todo lo que forma parte del edificio en sí: paredes, suelos, techos, instalaciones fijas de agua, luz y gas, puertas, ventanas, cocina empotrada y baños. No incluye los muebles ni los objetos personales.

Everything that is part of the building itself: walls, floors, ceilings, fixed water, electricity and gas installations, doors, windows, fitted kitchen and bathrooms. It does not include furniture or personal belongings.

Contenido Contents (contenido) Todo lo que hay dentro de la vivienda. Everything inside the home.

Los muebles, electrodomésticos, ropa, joyas, electrónica y demás pertenencias del asegurado y su familia. Se asegura por separado del continente y tiene su propio capital. Si alquilas tu vivienda vacía, normalmente no necesitas asegurar contenido.

Furniture, appliances, clothing, jewellery, electronics and other belongings of the insured and their family. It is insured separately from the building and has its own sum insured. If you rent out an empty property, you usually don't need contents cover.

Suma asegurada Sum insured (suma asegurada) El tope máximo que puede pagar el seguro. The maximum the insurance will pay.

Es el valor máximo que la compañía indemnizará en caso de siniestro total. Para el continente debe reflejar el coste de reconstruir la vivienda desde cero, no el precio de mercado del inmueble. Fijarla correctamente es fundamental para evitar el infraseguro.

The maximum amount the company will pay out in the event of a total loss. For the building, it should reflect the cost of rebuilding the home from scratch, not the property's market price. Setting it correctly is key to avoiding under-insurance.

Valor de reposición Replacement value / New-for-old (valor de reposición) Lo que cuesta comprar el bien nuevo hoy. What it costs to buy the item new today.

Es el importe necesario para adquirir un bien nuevo igual o equivalente en el mercado actual. Las pólizas que indemnizan a valor de reposición pagan sin descontar el desgaste o la antigüedad del objeto dañado. Es la cobertura más favorable para el asegurado.

The amount needed to buy a new, identical or equivalent item on today's market. Policies that pay on a replacement-value basis pay without deducting wear or age from the damaged item. It is the most favourable cover for the insured.

Valor real Actual value (valor real) Lo que vale el bien teniendo en cuenta su antigüedad. What the item is worth allowing for its age.

Es el valor de reposición menos la depreciación por uso, desgaste o antigüedad. Si tu televisor de 5 años se daña, recibirás menos de lo que costaría uno nuevo porque se descuenta su desgaste.

The replacement value minus depreciation for use, wear or age. If your 5-year-old TV is damaged, you'll receive less than a new one would cost because its wear is deducted.

Infraseguro Under-insurance (infraseguro) Tener asegurado menos de lo que realmente vale. Insuring for less than the real value.

Ocurre cuando el capital asegurado es inferior al valor real del bien. En un siniestro parcial la compañía aplica la regla proporcional: si tienes asegurado el 70 % del valor real, solo te indemnizarán el 70 % del daño. Para evitarlo conviene revisar los capitales cada pocos años.

Occurs when the sum insured is lower than the real value of the property. On a partial claim the company applies the average rule: if you have insured 70% of the real value, you will only be paid 70% of the damage. To avoid it, review your sums insured every few years.

El siniestro

The claim

Siniestro Claim / Incident (siniestro) El daño o accidente que activa el seguro. The damage or incident that triggers the insurance.

Cualquier hecho cuyas consecuencias estén cubiertas por la póliza: un escape de agua, un incendio, un robo... Se considera un único siniestro el conjunto de daños que tenga una misma causa, aunque se manifiesten en momentos distintos. Hay que declararlo a la compañía lo antes posible.

Any event whose consequences are covered by the policy: a water leak, a fire, a theft... All the damage from a single cause counts as one claim, even if it appears at different times. It must be reported to the company as soon as possible.

Daños estéticos Matching items / Aesthetic damage (daños estéticos) Cuando el siniestro afecta al aspecto visual de la vivienda. When the claim affects how the home looks.

Ocurre cuando un siniestro cubre solo una parte del suelo o la pared pero, para una reparación visualmente coherente, habría que rehacer toda la estancia. Las pólizas que incluyen esta cobertura asumen ese coste extra hasta un límite, habitualmente entre 3.000 € y 9.000 €.

Occurs when a claim covers only part of the floor or wall but, for a visually consistent repair, the whole room would need redoing. Policies that include this cover meet that extra cost up to a limit, usually between €3,000 and €9,000.

Responsabilidad civil Liability (responsabilidad civil) Si causas daños a otros, el seguro responde por ti. If you cause damage to others, the insurer answers for you.

Cubre las reclamaciones de terceros cuando el asegurado o alguien de su familia causa daños a otras personas o sus bienes. Por ejemplo: una fuga de tu piso inunda al vecino de abajo, o tu hijo rompe una ventana jugando. Los límites habituales oscilan entre 150.000 € y 600.000 € según la modalidad.

Covers third party claims when the insured or a family member causes damage to other people or their property. For example: a leak from your flat floods the neighbour below, or your child breaks a window while playing. Typical limits range from €150,000 to €600,000 depending on the cover.

Perito de seguros Loss adjuster (perito) El experto que valora los daños del siniestro. The expert who assesses the claim damage.

Es el profesional que designa la compañía para inspeccionar los daños y calcular la indemnización. Si el asegurado no está de acuerdo con su valoración, tiene derecho a nombrar su propio perito. Si ambas partes no se ponen de acuerdo, se nombra un tercer perito dirimente.

The professional the company appoints to inspect the damage and calculate the compensation. If the insured disagrees with their valuation, they have the right to appoint their own adjuster. If both parties cannot agree, a third deciding adjuster is appointed.

Asistencia en el hogar Home assistance (asistencia en el hogar) Servicio de reparaciones urgentes incluido en la póliza. Emergency repair service included in the policy.

Es una prestación de servicios —no una indemnización en dinero— que cubre reparaciones urgentes: fontanería, electricidad, cerrajería, cristalería... La compañía manda al profesional y paga su intervención. Suele estar disponible las 24 horas.

A service benefit — not a cash payment — covering emergency repairs: plumbing, electrics, locksmith, glazing... The company sends the professional and pays for their work. It is usually available 24 hours a day.

Ocupación ilegal Illegal occupation / Squatting (ocupación ilegal) Cobertura frente a los ocupantes no autorizados. Cover against unauthorised occupants.

Algunas pólizas incluyen asistencia jurídica y cobertura de gastos para recuperar la posesión de la vivienda si ha sido ocupada ilegalmente. Cubre honorarios de abogado y procurador y, en algunos casos, los daños causados por los ocupantes. Desde junio de 2026, Allianz la incluye en toda su gama de hogar.

Some policies include legal assistance and cost cover to recover possession of the home if it has been illegally occupied. It covers solicitor and court agent fees and, in some cases, the damage caused by the occupants. Since June 2026, Allianz includes it across its entire home range.

La indemnización

The compensation

Regla proporcional Average rule (regla proporcional) La penalización por tener el seguro bajo de capital. The penalty for insuring for too little.

Si existe infraseguro, la compañía no paga el 100 % del daño sino en proporción a la parte asegurada. Muchas compañías renuncian a aplicarla si aceptaste los capitales que ellos propusieron al contratar, o si la diferencia no supera el 10 %. Es un mecanismo legal previsto en la Ley del Contrato de Seguro.

If there is under-insurance, the company does not pay 100% of the damage but in proportion to the insured share. Many companies waive it if you accepted the sums insured they proposed when taking out cover, or if the shortfall is no more than 10%. It is a legal mechanism set out in the Insurance Contract Act.

Sublímite Sub-limit (sublímite) El tope para una cobertura específica dentro de la póliza. The cap for a specific cover within the policy.

Es un límite concreto que aplica a una cobertura determinada, independientemente del capital general asegurado. Por ejemplo: una póliza puede tener 100.000 € de capital total pero solo cubrir hasta 1.500 € en robo de joyas o hasta 300 € en dinero en efectivo. Revisar los sublímites es tan importante como revisar el capital total.

A specific limit that applies to a particular cover, regardless of the overall sum insured. For example: a policy may have €100,000 of total cover but only pay up to €1,500 for theft of jewellery or up to €300 for cash. Checking the sub-limits is as important as checking the total sum insured.

Primer riesgo First-loss basis (primer riesgo) Se paga el daño hasta el límite pactado, sin penalización. Pays the damage up to the agreed limit, with no penalty.

Modalidad de cobertura en la que la compañía indemniza el daño hasta la suma acordada sin aplicar la regla proporcional, aunque el valor total de los bienes sea mayor. Se usa habitualmente en coberturas como el robo o los daños eléctricos.

A type of cover in which the company pays the damage up to the agreed sum without applying the average rule, even if the total value of the property is higher. It is commonly used for covers such as theft or electrical damage.
